Terms of Service

These terms are provided for general information only and do not constitute legal advice.
These Terms of Service (“Terms”) govern the use of the AI Furniture visualiser widget and related services (collectively, the “Service”) provided by us to furniture retailers (“Retailers”). By using or integrating the Service, you agree to these Terms.
1. The Service
The Service enables shoppers on a Retailer’s website to upload a room photo and preview how certain furniture products might look in that space. The Service generates AI-based visualisations using retailer product data and user-supplied images.
2. Relationship between us, retailers and shoppers
- We provide the underlying visualiser technology and dashboard.
- Retailers integrate the widget into their own websites and control their product catalogue, pricing, and sales terms.
- End shoppers contract directly with the relevant retailer, not with us, for any purchase of products.
We are not a party to the sale of products between retailers and shoppers. We do not set prices, delivery terms, returns policies or guarantees for those products.
3. Visualisations are illustrative only
The visualisations generated by the Service are designed to help shoppers understand how a product might look in a given room. They are illustrative approximations, not technical drawings, architectural plans or exact digital twins.
While we aim for realistic placement, angle, scale and colour, several factors can affect the outcome, including:
- Quality, lighting and perspective of the uploaded room photo.
- Accuracy and completeness of product dimensions, images and metadata supplied by the retailer.
- Limitations inherent in current AI and image-generation technology.
As a result, we do not warrant that any visualisation is perfectly accurate in terms of measurements, colours, materials or fit. Visualisations are a helpful guide only and must not be relied upon as the sole basis for purchasing decisions or building works.
4. Sizing, measurements and suitability
The ultimate responsibility for ensuring that a product will fit and is suitable for a given space lies with:
- The retailer, for:
- Providing accurate product dimensions, materials, specification and installation requirements.
- Ensuring that product descriptions and technical information on their website are correct and up-to-date.
- The end customer, for:
- Taking actual measurements of their room, doorways, hallways and access routes.
- Comparing those measurements with the retailer’s published dimensions.
- Making their own judgement about whether the product will fit and is appropriate for their circumstances.
To the maximum extent permitted by law, we disclaim any liability for:
- Products that do not physically fit into a customer’s property or chosen room.
- Products that cannot be delivered due to access constraints (stairs, doorways, lifts, etc.).
- Differences between visualised images and real-world appearance, including but not limited to colour, shade, texture, scale or lighting.
5. Retailer responsibilities
By integrating the Service, the retailer agrees to:
- Provide accurate and lawful product data, including images, dimensions and descriptions.
- Obtain any rights, licences or consents needed to use product images, logos and branding with our Service.
- Implement and maintain a compliant privacy and cookie notice on their own website.
- Inform shoppers that visualisations are indicative only and that they must check measurements before buying.
- Not use the Service for any unlawful or discriminatory purpose.
6. Our use of images and data
We process room photos, product images and related metadata for the sole purpose of providing and improving the Service, in line with our Privacy Policy.
We may:
- Store and process images on our own infrastructure or on third-party cloud and AI providers.
- Generate and store anonymised or aggregated statistics about widget usage and product interactions.
- Maintain logs and technical information for security, performance monitoring and billing.
We do not sell personally identifiable information about end shoppers. Where we offer anonymised or aggregated insights (for example, patterns in the types of rooms or products visualised), these are produced in a way that does not identify a specific individual or household.
7. Intellectual property
All rights, title and interest in and to the Service (including software, models, dashboards, documentation and generated system prompts) are and remain ours or our licensors’. Retailers retain all rights in their own product data, images and branding.
Subject to payment of applicable fees and compliance with these Terms, we grant retailers a limited, non-exclusive, non-transferable licence to embed and use the widget on their own sites for the duration of the agreement.
8. Acceptable use
Retailers must not use the Service to:
- Upload or encourage the upload of unlawful, abusive, defamatory, or infringing content.
- Attempt to reverse engineer, decompile or otherwise access the underlying models or source code.
- Use the Service in a way that could damage, disable or impair our systems or those of our providers.
- Mislead shoppers about what the Service does or represent visualisations as guaranteed outcomes.
9. Fees and billing
Fees, billing models (such as per-use, per-product or subscription) and payment terms are agreed separately in an order form, proposal or subscription agreement between us and the retailer. We may suspend or limit the Service if invoices are not paid on time.
10. Service levels and availability
We aim to keep the Service available and responsive, but we do not guarantee uninterrupted or error-free operation. We may temporarily suspend the Service for maintenance, security or technical reasons and will use reasonable efforts to minimise disruption.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without any warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement or reliability.
12. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any loss of profits, revenue, data, business, or any indirect, incidental, special or consequential damages arising out of or in connection with the use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to a retailer in respect of all claims arising out of or in connection with the Service (whether in contract, tort or otherwise) shall be limited to the fees paid by that retailer for the Service in the 12 months preceding the event giving rise to the claim.
13. Indemnity
Retailers agree to indemnify and hold us harmless from any claims, damages, liabilities, costs and expenses arising out of: (a) their misuse of the Service; (b) their inaccurate or misleading product data; or (c) their breach of these Terms or applicable law.
14. Term and termination
The agreement between us and a retailer continues for the term set out in the relevant order or subscription. Either party may terminate for material breach that is not cured within a reasonable period, or as otherwise provided in the commercial agreement. On termination, retailers must remove the widget from their sites and cease using the Service.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, where appropriate, notify retailers or provide notice via our dashboard or website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction, except where mandatory law provides otherwise.
